Terms and Conditions
This service contract commences on July 24, 2018 inclusive of the following terms and conditions between the Traveler and Charmzone Travel (hereafter "the Company").
Submission of payment to Charmzone Travel ("the Company") signifies the acceptance of the following terms and conditions. Services
The Company offers travel-related services and accommodations, including the following:
1. Travel packages including but not limited to one day local tours, multi-day and multi-city tours, and customized individual/group tours.
2. Transportation services including but not limited to chartered and chaeuffeured vehicles to/from airports, to/from event venues, and to/from hotels, restaurants, and/or shopping malls. Reservation, deposit, payment, cancellations, and refunds
Reservations
Reservations will be made using the "Contact Us" form, email, or phone. Confirmation will be sent by the Company to the Traveler via email.
The Traveler will be responsible for confirming that details are correct on the confirmation email sent by the Company. Any inaccuracies must be reported by the Traveler as soon as the inaccuracy is discovered.
Reservations may be refused or cancelled for any of the following reasons:
-If the Traveler is determined by the Company or any of its guides as negatively affecting other travelers or the smooth and timely operation of the tour.
-If the Traveler is determined by the Company or a certified medical professional as being unfit to travel due to health concerns.
-If the maximum for a tour for a date the Traveler had requested a reservation for has exceeded the maximum number of travelers.
-If the minimum for a tour for a date the Traveler had requested a reservation for has not met the minimum number of travelers.
-If the Traveler has violated the terms and conditions before the date of the reservation.
In cases where the Company terminates the reservation due to the Traveler violating the above terms, the Traveler forfeits a refund.
Deposits and Payments
10% deposit of the total price should be made within three (3) business days from the date of booking confirmation by any of the following:
-Credit card
-Wire transfer
-Bank transfer
If the cost per person is $300 or lower, full payment must be made within three (3) businses days from the date of booking confirmation.
If the departure date is within fifteen (15) days of reservation, full payment must be made at the time of booking confirmation.
Full payment due fifteen (15) days prior to departure. Failure to make final full payment on time may result in cancellation of reservation and loss of deposit.
The following items are not included in package costs and the Traveler bears responsibility for paying for any of the following items that may occur during travel:
-Personal expenses during travel (e.g. roaming fees, tips for service staff and guides, laundry facility fees, any food/drink not specified in tour contract, etc.).
-Medical expenses including but not limited to expenses related to illness, injury, or preexisting conditions that require hospitalization, treatment, and/or medications.
-Fees related to the Traveler violating terms and conditions of either the Company or any third parties including but not limited to damage fees, excess baggage fees, tickets as issued by a peace officer, etc.
-Fees related to travel procedures including but not limited to visa fees, passport issuance/renewal fees, airline fees not specified in tour contract, etc.
-Fees related to additional services that is not outlined and included in the original reservation.
-Any fees not included in the original reservation.
Cancellation
Cancellation by the Company
-The Company reserves the right to change or cancel reservations based on the following conditions:
-1. In cases where the Company and/or guide determine the original reservation poses a safety risk to the Traveler (e.g. travel advisories at tour locations).
-2. Acts of God (e.g. natural disasters including but not limited to wildfires, earthquakes, severe weather).
-3. In cases where contracted third parties are experiencing labor strikes/shortages.
Cancellation by the Traveler Refunds for "Recommended Tour" packages
-15 or more days prior to departure: full refund excluding any reservation fees/ticket fees of optional tour items purchased
-8-14 days prior to departure: 25% refund excluding any reservation fees/ticket fees of optional tour items purchased
-0-7 days prior to departure or no show: No refunds
Refunds for "Custom Tours"
-21 days or more prior to departure: full refund excluding any reservation fees/ticket fees and $400 consultation/planning fee
-8-20 days prior to departure: 25% refund exclusing any reservation fees/ticket fees and $400 consultation/planning fee
-0-7 days prior to departure or no show: No refunds
Refunds for "Premium Custom Tours"
-21 days or more prior to departure: full refund excluding any reservation fees/ticket fees and $1,500 consultation/planning fee
-8-20 days prior to departure: 25% refund excluding any reservation fees/ticket fees and $1,500 consultation/planning fee
-0-7 days prior to departure or no show: No refunds
Refunds for Additional Services
(e.g. travel agent services provided for the Company to the Traveler including airline ticket booking, hotel booking, etc).
-No refunds regardless of period of notification.
Refunds for Transportation
-15 days or more prior to transportation service: full refund for direct deposit payments; full refund after 3.9% deduction of credit card surcharge for credit card payments.
-8-14 days prior to transportation service: 25% refund for direct deposit payments; 25% refund after 3.9% deduction of credit card surcharge for credit card payments.
-0-7 days prior to departure or no show: No refunds.
Traveler's Responsibilities
-The Traveler shall bear all responsibility for reimbursing the Company for any damages/losses incurred by the Company or any of the guides due to the intential or negligent actions of the Traveler.
-The Traveler acknowledges that any sexual harassment/assault/battery and/or any criminal offense committed by the Traveler shall be reported to police and will be prosecuted to the full extent of United States law. The Traveler shall bear all financial responsibility for any fines, attorney fees, bail, etc. resulting from any criminal action.
-The Traveler bears responsibility for reviewing the confirmation email and itinerary fully. The Company bears no responsibility for consequences arising out of any misunderstanding on the Traveler's part.
-The Traveler will submit payment(s) to the Company in a timely manner as outlined in these terms and conditions.
-The Traveler will follow the Company and/or the guide's instructions during any tour package to ensure smooth operation.
-The Traveler shall not make any demands to the Company and/or the guide for additional services unrelated to the tour package purchased.
-The Traveler bears responsibility for securing their own valuables and posessions at all times during the tour itinerary. If valuables/possessions are lost or stolen from the Traveler during the tour itinerary, the Traveler bears responsibility for submitting paperwork to the Company and/or the Traveler's travel insurance company including but not limited to the following:
-1. Police report (if filed)
-2. Report of theft
-The Traveler bears responsibility for complications that arise from disabilities, injuries, infectious diseases, etc. that were not previously disclosed to the Company at the time of reservation. If complications arise from disabilities, injuries, infectious diseases, etc. during the tour itinerary, the Traveler bears responsibility to report the following to the Company and/or the Traveler's insurance company (traveler's insurance and/or medical insurance):
-1. Report of accident (if complications are the result of an accident during the tour itinerary)
-2. Medical diagnosis (only to be submitted to the Traveler's insurance company)
-3. Receipt(s)
The Company's Responsibilities
-The Company and its guides will try to the best of their abilities to adhere to the Traveler's tour reservation itinerary to ensure full enjoyment and safety of the Traveler except in cases outlined in section titled "Cancellation by the Company."
Responsibility of Company Tour Guides
The Company's tour guides' responsibilities and duties are outlined below:
-1. In the case that a Company tour guide has violated the travel contract with the Traveler that are not due to any circumstances outlined in the section "Traveler's Responsibilities," the tour guide will reimburse the Traveler for any damages. In the case that there are no physical injuries to the Traveler, the reimbursement by the tour guide to the Traveler shall be no more than 100% of the reservation price. Reimbursement does not apply if the contract was broken due to violation on the part of the Traveler as outlined in the section "Traveler's Responsibilities."
-2. In the case that a Company tour guide causes harm to the Traveler through intent or negligence, the tour guide shall reimburse the Traveler.
-3. In the case that a Company tour guide harasses or assaults the Traveler, the Traveler has the right to pursue legal and criminal action. If found guilty through a court of law, the tour guide shall bear full responsibility for any fines, settlements, etc.
-4. The Company tour guide does not bear any responsibility to receive, send, or safekeep any Traveler's items, belongings, luggage, etc. and in the case that the Traveler asks the Company tour guide to do any of the aforementioned, the Company and the tour guide bears no responsibility for any losses, damages, delays, etc. to the Traveler.
Company Policies on Damages
-1. If the Company, while performing services outlined in the contract, causes physical or material losses to the Traveler through intent or negligence, the Company shall only reimburse the cost of the damages to the Traveler's person.
-2. If any damages occur as a result of the Company tour guide's intent or negligence, the Company shall not bear any responsiblity and the tour guide shall bear all responsiblities as outlined in section "Responsiblity of Company Tour Guides."
Delays
-1. In the case that services outlined in the contract are delayed due to a Company tour guide failing to arrive on time to a predetermined rendezvous point, the Company tour guide shall make up the amount of time to the Traveler and shall add on the amount of time of the delay at another point in the tour.
-2. In the case that a Company tour guide fails to arrive to a predetermined rendezvous point without prior communication of any delays, the Traveler reserves the right to terminate the contract.
-3. In the case that the Traveler is late to a predetermined rendezvous point (less than 1 hour), the Company tour guide will commence with services outlined in the contract as planned.
-4. In the case that the Traveler is late to a predetermined rendezvous point (more than 1 hour without prior communication), the Company and/or the Company tour guide reserves the right to terminate the contract.
-5. In the case that a tour must be stopped or delayed due to no fault of the Traveler, the Company, or the Company tour guide (e.g. acts of God, extreme weather, traffic accidents, etc.), the Company shall refund the Traveler a prorated amount based on the amount of time left on the services as defined in the contract. The Company bears no additional responsiblity to the Traveler other than a prorated refund.
Unplanned Cancellations
-1. Neither the Traveler nor the Company and its tour guides are able to cancel services as outlined in the contract after services commence, unless it is due to unavoidable circumstances (e.g. emergencies). All other cancellations shall be subject to the terms and conditions outlined in the section "Cancellations."
-2. If the Traveler must cancel services as outlined in the contract due to unavoidable circumstances, the Company bears no responsibility for refunding the Traveler. If the unavoidable circumstances are due to injuries sustained as a result of the Company tour guide's negligence, all matters shall be subject to the terms and conditions outlined in the sections "Responsibilty of Company Tour Guides" and "Company Policies on Damages." Damages shall be capped at 100% of the cost of services rendered.
Changes to Services
The Company and the Company tour guides are required to communicate any and all changes, planned or unplanned, to the Traveler in a way that the Traveler can understand. This includes, but is not limited to, changes due to delays, road conditions, attraction closures, etc.
Privacy
The Company will not sell or otherwise provide any identifying information of the Traveler, including but not limited to name, birth date, nationality, Social Security Number/Alien Registration Number, and contact information, unless required by law enforcement.
The Company reserves the right to take photos, videos, or recordings during services rendered for promotional purposes. The Company shall notify any Traveler in the photo, video, or recording prior to usage to obtain consent.
